However you’ve got yourself here, welcome to our Terms and Conditions page, a page that can be seen as the ‘boring bit’ of a website, but one that’s quite important as it sets out the terms of this website and what each party (i.e. you and us) agree to do.

In using this website, you’re deemed to have read and agreed to the following terms and conditions. We may change these Terms and Conditions without letting you know; therefore, it is up to you to check this page for any changes. Your continued use of our website means you have accepted these Terms and Conditions and the Privacy Statement.

If you do not accept these Terms and Conditions, we ask that you leave our website now.

You must be over 18 years old to buy goods from this site. If you are under 18, you can only use this site with the involvement of a parent or guardian.

Order Acceptance and Contract

Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please carefully check your order on each page of the order process.

After you have placed your order through lucalondon.com, we'll notify you by email as soon as possible to confirm receipt of your order. Any order you place is an offer to purchase and will be accepted by us, subject to stock availability. If something is not in stock, we will let you know either at the time of ordering or as soon after the order has been placed as possible. 

A contract for the sale of the goods will be formed when we send email confirmation to you that we've dispatched the product to you at the address you provided us with. The contract between us will only be formed when we send you the Dispatch Confirmation. It's worth remembering that any products on the same order we have yet to confirm in the confirmation email to be dispatched do not form part of that contract.

If we cannot verify the delivery or payment information you supplied, we may restrict delivery to the address to which your credit or debit card is registered.

We also reserve the right to change any of the details of the garments on the site at any time, including prices, colours, and sizes. 

Payments:

We accept all major credit cards (MasterCard / Visa), debit cards (Visa Debit / Visa Delta / Visa Electron), and Stripe and PayPal payments. We also accept payments via KlarnaPay, Clearpay and Laybuy (please refer to each respective website for details of their Terms and Conditions.)

Any credit card used for payment must be in the name of the person ordering it, and the same card must be carried at the time of delivery. It may be required for verification.

All payments are processed through third-party payment gateways using PCI Encryption. 

Pricing 

All prices stated on this website include and are subject to the current rate of UK VAT at the current prevailing rate. However, if the rate of VAT changes between the date of your order and the date of delivery, where applicable, we will adjust the VAT you pay unless you have already paid for the products in full before the change in VAT takes effect.

Our site contains many products, and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures. If we accept and process your order where a pricing error is obvious and unmistakable and could have reasonably been recognised by the average customer as an error, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

Delivery

Please refer to our Shipping Section on our website for more details on delivery and shipping.

Deliveries are sent to the delivery address given at the time of order. You, the customer, accept full responsibility for ensuring the accuracy of the information provided.

You accept and agree that we will not be liable for delayed deliveries.

You accept and agree that we will not be liable for missing deliveries. However, we will make like-for-like replacements if a delivery goes missing due to the fault of a 3rd party (i.e. courier) after sufficient time has elapsed and after you agree to assist us in any subsequent investigations for compensation from said 3rd party, which can take up to 30 days.

We do not deliver to PO Box or hotel addresses or refund outbound postage costs.

We welcome orders from most overseas, but please note that local import duties may be payable upon receipt. This website and its contents do not form an agreement between Luca London and a customer in a jurisdiction where the products offered for sale would go against any local, regional, or national laws. If you know that it would be illegal for us to sell our products in your country, please do not order items from our site.

Luca London Warranty

Our warranty is only valid and applicable to new goods purchased by the original purchaser. It does not apply to any clothing resold or passed onto someone else.

This warranty is also invalidated if you allow a third party to repair or attempt to repair any item.

In the event of a dispute regarding the cause of damage, we reserve the right to send the product to a mutually agreed independent third-party assessor to determine the nature of the defect. We repair the item only if their judgement indicates a defect in material or workmanship. This warranty does not cover expenses due to insufficient product care.

Please keep your proof of purchase documents – they will be required to procure warranty service if you wish to make a warranty claim.

Please notify Buy Labels For Less Ltd (T/A Luca London) within 14 days of purchase if you wish to claim a replacement for a defect.

Returns & Refunds

Please refer to our Refund Section on our website for more details on returns and our refund policy.

Our Returns Policy applies to all purchases made from Luca London. Our Returns and Exchange Policy are that if you are not entirely satisfied with the product purchased, you can return within the ‘cooling-off’ period of 14 days (UK)/30 days (International) for a refund or exchange.

You may decide whether to return an item to us for a refund or exchange, but your return must be post-marked (in the mail) within 14 days (UK)/30 days (International) of receiving your order. The value of the refund or exchange is limited to the total cost of the returned item(s).

If you wish to return a Product to us, either under the rights provided by the Regulations or if you believe the product is damaged or is the subject of a fault, and you are relying upon your statutory rights and/or you believe that our warranty covers the product, you should not make further use of the product. Use of the product can, in circumstances outside of the Regulations, lead to a reduction in the amount of refund you may be entitled to.

If you infringe upon Luca London’s rights concerning any Luca London Proprietary Property, you will be ordered to cease such illegal activity, and you may be liable to Luca London for any damages (including recovery of legal fees and expenses) which may be suffered and incurred because of your infringement.
